Six checks account for almost every property dispute we see involving foreign buyers in Antalya. They can be completed in three to five business days and they are the whole of the difference between a secure purchase and a lawsuit.
The title record
The land registry record shows the registered owner, the share structure, and any annotation, mortgage, lien, injunction, right of usufruct or expropriation decision attached to the property. It is definitive; what appears in a brochure is not. Land registry procedures are published by the General Directorate of Land Registry and Cadastre. A property with an unresolved mortgage can still be marketed, viewed and reserved, and the buyer only discovers the position at the registry counter.
Eligibility and location restrictions
Foreign nationals cannot acquire property in military zones or security areas, and cannot exceed thirty hectares individually across Turkey. There is also a district-level ceiling: foreign ownership cannot exceed ten percent of the privately owned area within any given district. Parts of the Antalya region are affected by these limits, and eligibility depends on both the nationality of the buyer and the exact parcel. Occupancy permit and zoning status
A building without an occupancy permit is legally incomplete regardless of how finished it looks. The consequences are practical: difficulty with utility subscriptions, difficulty with resale, difficulty with mortgage finance and, where the deficiency is structural, exposure to municipal enforcement. Zoning status also determines whether the plot can be built on at all in the case of land purchases, and whether the existing structure conforms to what was permitted.
The valuation report
Foreign buyers require a valuation report prepared by an appraiser licensed by the Capital Markets Board. The report matters twice: it governs the declared value for tax purposes, and where a citizenship application is contemplated, the valuation rather than the price paid determines whether the threshold is met. A purchase price above the valuation does not close that gap.
The seller and the payment chain
Verification that the seller is the registered owner, or holds a valid power of attorney from the owner with the required special authority and photograph, prevents the most damaging category of fraud. Payment routing matters as well, because funds transferred outside the banking system are difficult to trace and difficult to recover.
Debt and charges attaching to the property
Unpaid property tax, unpaid maintenance charges to the site management, and unpaid utility bills follow the property in various ways, and a buyer who has not checked inherits an argument with the site management on the first day.
Once the file is clean, the transfer itself is quick. The parties or their representatives attend the land registry appointment, the transfer fee is paid, compulsory earthquake insurance is arranged, and the title is registered the same day. ⚖️ Residence Permits and Immigration in Antalya
Residence permits in Antalya are refused more often than in most Turkish provinces, and the reason is a policy that catches foreign buyers by surprise: registration in certain neighbourhoods is closed to new foreign residents once the foreign population there passes a set proportion of the total. A property purchase does not create a right of residence, and a property in a closed neighbourhood can leave the owner unable to register an address at the property they own.
This is the single most important thing to check before buying in Antalya if residence is part of the plan, and it is checked at neighbourhood level rather than district level. The current position for a specific address should be confirmed before the purchase rather than after, through the Directorate General of Migration Management at goc.gov.tr.
The permit routes most relevant to foreign clients in Antalya:
- Short-term residence permit. The common route for property owners and long-stay visitors. Granted for limited periods and renewable, subject to health insurance, address registration and financial means.
- Family residence permit. For spouses and dependent children of Turkish citizens or of permit holders.

- Long-term residence permit. Available after continuous lawful residence over an extended period, subject to conditions.
Refusals are appealable, and a significant proportion of the refusals we see are procedural rather than substantive: a missing insurance policy, an address registration that does not match, an application filed in the wrong category, or a gap in lawful presence created by a lapsed permit. “Is a refusal the end of it?” No. Refusal decisions carry an appeal right with a short deadline, and the deadline is the part clients most often miss because the decision arrives while they are abroad. Antalya property qualifies for Turkish citizenship by investment on the same terms as property anywhere else in Turkey: a minimum investment of USD 400,000 as of current regulations, with an annotation registered on the title deed committing not to sell for three years. What differs in Antalya is not the rule but the practical route to satisfying it.
Three points cause more refused Antalya applications than any other.
Valuation, not price. The threshold is measured against the report of a licensed appraiser. In coastal markets where prices carry a lifestyle premium, the valuation can land materially below the amount paid. A buyer who paid USD 420,000 and holds a valuation of USD 380,000 has not met the threshold, and discovers this at the application stage rather than at the purchase stage.
Aggregation across multiple properties. Buyers frequently assemble the threshold from two or three smaller apartments, which is permissible but carries conditions on how and when the purchases are made. Assembling the total over a long period, or through different transaction structures, can break the aggregation.
The seller’s history. A property that has previously been used for a citizenship application, or that was sold by a foreign national to another foreign national in certain circumstances, may not qualify. This is a records question rather than a judgement question, and it is answerable before purchase.

⚖️ Private Client, Inheritance and Estate Matters in Antalya
A property in Antalya owned by a foreign national is subject to Turkish inheritance law on death, regardless of any will made at home. This surprises almost every client who hears it for the first time, and it is the reason the Antalya coast generates a steady flow of estates that nobody planned for.
Turkish succession law applies the principle of reserved shares. A defined proportion of the estate passes to the surviving spouse, children and, in their absence, other statutory heirs, and that entitlement cannot be defeated by a will disposing of the property elsewhere. An English will leaving a Turkish apartment to a stepchild does not achieve that result if a biological child objects.
The procedural position matters as much as the substantive one. Where the estate has a foreign element, and it does whenever the heirs are abroad, the certificate of inheritance must be obtained from the civil court of peace rather than from a notary. Turkish notaries are not competent to issue one in these cases. Following the certificate, the estate is registered at the land registry, the inheritance tax declaration is filed, and the heirs decide whether to hold or liquidate.
Two deadlines run whether or not the family is aware of them. Rejection of an inheritance carries a three-month period from the date the heir learns of the death. Inheritance tax declarations carry their own filing periods with penalties attached. Families who wait until everyone has agreed on a distribution frequently find the legal position has been settled by inaction in the meantime.
Planning ahead is straightforward and rarely done. Foreign clients in Antalya use Turkish companies for three reasons: to hold and let property at scale, to operate a business in tourism, hospitality or services, and to structure an investment in a way that suits their position at home.
Incorporation runs through the MERSIS system and the trade registry directorate, and can be completed by an advocate under power of attorney without the shareholders entering Turkey. Registration typically completes within three to five business days once the documentation is in order; the realistic period from first instruction to a company with a working bank account is three to six weeks, and the variable is almost always document certification abroad.
Two decisions are worth taking before rather than after incorporation. Whether a limited company or a joint stock company fits the exit plan, because converting later is possible but inconvenient. And whether property should be held personally or through the entity, because the two structures produce different outcomes for taxation, for residence permit eligibility and for succession. After enough files the pattern stops being individual and becomes structural. These are the errors that recur, in rough order of how expensive they turn out to be.

- Paying a deposit before the title check. Deposits are frequently non-refundable by contract, and the buyer discovers the defect after the money is committed.
- Signing a contract in a language you do not read. A Turkish contract governs. An English translation supplied by the seller is a courtesy, not an instrument.
- Assuming a purchase creates residence rights. It does not, and in a closed neighbourhood the property may not even support an address registration.
- Buying for citizenship without a prior valuation. The threshold is measured on the valuation report, not the price paid.
- Ignoring the occupancy permit. A completed-looking building without one carries resale and finance consequences that surface years later.
- Leaving no succession plan. Turkish reserved share rules will apply to the property whatever a foreign will says.
- Granting an unlimited power of attorney. A general authority handed to a person met once is an exposure that never announces itself.
- Letting a permit lapse while abroad. A gap in lawful presence complicates every subsequent application, and the deadline runs regardless of where you are.
None of these are difficult to avoid. All of them are difficult to reverse.
